1. Copyright Infringement Notification
If you believe that content available on or through USPatriotNews.com infringes upon your copyright, you may submit a written notification of claimed infringement to our designated DMCA Agent. Your notification must be in writing and must include the following information, as required by 17 U.S.C. § 512(c)(3):
- Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

Providing URLs in the body of your notification is the best way to help us locate content quickly.
- Your Contact Information: Information reasonably sufficient to permit us to contact you, including your full legal name, mailing address, telephone number, and email address.
- Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys’ fees incurred by the alleged infringer, the copyright owner, or the service provider.

3. Processing of Infringement Claims
Upon receipt of a valid DMCA notification that complies with the requirements set forth above, USPatriotNews.com will take the following actions:
- Promptly remove or disable access to the allegedly infringing material
- Notify the content provider, member, or user who posted the material that it has been removed or disabled
- Provide the content provider with a copy of the DMCA notification and inform them of their right to submit a counter-notification
If your notification does not substantially comply with the requirements of 17 U.S.C. § 512(c)(3), we may not be able to act upon it. We reserve the right to request additional information to verify the validity of a DMCA claim before taking action.
4. Counter-Notification Process
If you believe that material you posted on the Site was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification to our designated DMCA Agent. Your counter-notification must include the following information, as required by 17 U.S.C. § 512(g)(3):
- Identification of the Material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled (including the URL).
- Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your Contact Information: Your full legal name, mailing address, telephone number, and email address.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which USPatriotNews.com may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, USPatriotNews.com will:
- Promptly provide the original complaining party with a copy of the counter-notification
- Inform the original complaining party that the removed material will be restored or re-enabled within ten (10) to fourteen (14) business days
- Restore or re-enable access to the removed material within ten (10) to fourteen (14) business days after receiving the counter-notification, unless our designated DMCA Agent first receives notice from the original complaining party that a court action has been filed seeking to restrain the content provider from engaging in infringing activity related to the material on the Site
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, USPatriotNews.com has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
A “repeat infringer” is a user who has been the subject of more than one valid DMCA notification of claimed infringement. USPatriotNews.com will consider the totality of the circumstances in determining whether a user qualifies as a repeat infringer, including whether the user has submitted valid counter-notifications in response to prior claims.
6. Good Faith Requirement
USPatriotNews.com respects the rights of copyright holders and takes claims of infringement seriously. However, we also recognize the importance of free expression and fair use. We expect all parties to act in good faith when submitting DMCA notifications and counter-notifications.
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. Before submitting a DMCA notification, please carefully consider whether the use of the copyrighted material at issue constitutes fair use under 17 U.S.C. § 107. Fair use is a legal doctrine that permits limited use of copyrighted material without requiring permission from the rights holder, and it is an important consideration in the DMCA process.
